1. About us and these Terms

These Terms of Service ("Terms") apply to every use of atelier-royal.com and every order you place with us. The seller is Atelier Royal ("we", "us", "our"), VAT-registered in the United Arab Emirates. You can reach us at contact@atelier-royal.com.

By placing an order you accept these Terms, together with our Refund Policy, Shipping Policy and Privacy Policy. Please read them before ordering. You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.

2. Our service

Atelier Royal creates portraits in historical European styles from photos you upload. Portraits are created digitally, using generative image technology operated for us by our service providers and guided by the style you choose; they are not painted by hand. Each portrait is then prepared for print at full resolution for the size you order.

Gallery Canvas	Your portrait printed on cotton-polyester canvas, stretched over a 4 cm (1.6 in) wooden frame with mirrored edges, supplied with a mounting kit and without an outer frame, in 12 × 16, 16 × 20, 18 × 24 or 24 × 36 inches

We do not currently sell frames.
A Fine Art Print or Gallery Canvas does not include the digital file. You can add the Digital Artwork to your order as a separate item.
Each order can include one print or canvas portrait (in any quantity), plus any number of Digital Artworks. To order prints of different portraits, please place separate orders.
Product images on the website are illustrations. Each size has its own proportions (4:5, 3:4 or 2:3), and before checkout you see exactly how your portrait sits within the size you choose.

4. Previews and retries

Each photo you upload includes one free preview.
For each portrait, you can request up to 3 further previews ("retries") free of charge, in the same style or another one. Retries are available before you order: a print or canvas is made from the portrait you approved, and no re-creation is offered after ordering (see the Refund Policy).
Previews carry a visible watermark. The watermark is removed only from the artwork you buy.
To protect the service, we may limit the number of previews per person, device or day, and we may suspend access in case of abuse.
Previews are kept for 30 days if you do not order (see the Privacy Policy).

5. Your photos and permissions

You keep all rights in the photos you upload.
You confirm that you took the photo or have the right to use it, and that you have permission from everyone shown in it (we ask you to confirm this before each upload). If a photo shows a child under 18, you confirm that you are their parent or legal guardian or have their permission.
You allow us, and the service providers listed in our Privacy Policy, to use your photos only to create, prepare, print and deliver your portrait and to answer your questions, for as long as described in the Privacy Policy.

6. Acceptable content

You must not upload photos that are unlawful, sexually explicit, hateful, violent, or that infringe anyone's rights, or that show someone without their permission. We may refuse to create a portrait, or cancel an order, if we reasonably believe a photo breaches this section. If we cancel a paid order for this reason, we refund it in full.

7. Placing an order

You create and approve your portrait, choose a format and size, and add it to your cart.
You pay through Shopify's secure checkout.
We email you an order confirmation. The contract between you and us is formed when this confirmation is sent.
A print or canvas order cannot be cancelled or changed once it is placed: it goes into production shortly afterwards (see the Refund Policy). Please check your portrait, format, size and delivery address before you pay.

We may cancel an order and refund it in full if no portrait is attached to it within 72 hours, if the payment is suspected to be fraudulent, if a photo breaches section 6, or if a price shown was obviously wrong. We will tell you by email.

8. Prices, currency, taxes and payment

Prices are shown in US dollars (USD). Your card issuer may charge a currency-conversion fee.
Any VAT or sales tax that we are required to collect is either included in the price or added at checkout, and is always shown before you pay.
Import duties and taxes charged by the destination country are not included and are paid by the recipient (see the Shipping Policy).
Shipping is free: Standard, and Express where it is offered for your address.
Payments are processed securely through Shopify's checkout by our payment providers. We never see or store your full card details.

9. Delivery

Prints and canvases are made to order and delivered as described in our Shipping Policy. The Digital Artwork is delivered by email. Risk of loss passes to you when the parcel is delivered to the address you gave us.

10. Cancellations, returns and refunds

Prints and canvases are personalized and made to your specifications, so the statutory right of withdrawal does not apply to them, and an order for them cannot be cancelled or changed once it is placed. The Digital Artwork is supplied immediately at your express request; you lose your right of withdrawal once the download begins. The details, including reprints and refunds for damaged or defective items, are in our Refund Policy.

11. Your portrait: licence and intellectual property

The portrait is created for you. We grant you a perpetual, worldwide, non-exclusive licence to use the portrait you buy for personal, non-commercial purposes: to display it, print it for yourself, give it as a gift and share it on your personal social media.
You may not sell the portrait, or use it for advertising or any other commercial purpose, without our written permission.
To the extent that intellectual property rights exist in the portrait, they belong to us and are licensed to you as described above. We will not sell your portrait or make it available to anyone else, except as described in section 12 and in our Privacy Policy.
The Atelier Royal name, logo, website content, styles and example portraits are protected by intellectual property law and may not be copied without our permission.

12. Gallery and marketing use

We show a customer's portrait in our gallery or marketing only if they tick the optional box "You may feature my portrait in the gallery". Even then we show only the finished portrait: never your name, and never your original photo without asking you first. You can withdraw this consent at any time by writing to contact@atelier-royal.com; we will then remove the portrait from our website and stop using it in new material.

13. Artistic interpretation and likeness

Each portrait is an artistic interpretation in a historical style. We aim for a recognizable likeness, but clothing, setting and pose are imagined and some features may be interpreted. You approve the portrait before paying, and you can try again before you order; once an order is placed, the portrait is made as you approved it (Refund Policy, section 3).

14. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill.
Our products are for personal use. We are not liable for business losses (such as loss of profit or business opportunity).
Except where the law does not allow it, our total liability for any order is limited to the price you paid for that order.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law, nor does it affect your mandatory rights as a consumer.

15. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, strikes, carrier or customs disruptions, or outages of third-party services. If such an event affects your order, we will tell you and, if the delay is significant, you may cancel and receive a refund for anything not yet delivered.

16. Personal data

We process your personal data as described in our Privacy Policy.

17. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts of that country. If you are not a consumer, the competent courts of the United Arab Emirates have jurisdiction.

If you have a complaint, please write to us first at contact@atelier-royal.com; most issues can be resolved quickly and amicably. You may also contact the consumer protection authority of your country.

18. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one published on our website when you place it.
